Resumo:This dissertation analyzed the Intellectual Property and Technology Transfer within the World Trade Organization (WTO) in order to determine the consequences of regulation within that organization for developing countries. The general aspects and the history of Intellectual Property and Competition Law will be presented considering the advantages or otherwise of its regulation within the WTO sphere. Since the Agreement on Aspects of Intellectual Property Rights Related to Trade (TRIPs) establishes as one of its objectives that the protection and enforcement of intellectual property rules should encourage the transfer and dissemination of technology, it will be examined whether this goal has been achieved, evaluating both the regulation of technology transfer, as key indicators of international technology flows, which will help identify the global participation of developing countries in both the generation of intellectual property rights, and the international transfer of technology.
