Sumario:The family law has been going through transformations and today is in a continuous process of adaptation to social reality. Therefore, the objective of this work is to describe the regulatory drift of the Brazilian Civil Code, in force since 2003 and also demonstrate the need for timely adjustments in the legal text in order to avoid misinterpretations and that endanger human dignity. To achieve these attempts is dialectical methodology applied-descriptive, which seeks to establish an interface between practice, existing legislation and cultural phenomena experienced by households, according to the teachings of Anthony Giddens and Philippe Ariès.
