| Resumo: | This bibliographic study, aims to conduct a legal analysis regarding the sport in Brazil, as well as bringing a systematic overview Constitution sport papers. In order to observe whether there is unconstitutional punishment against some teams receive from the Brazilian Football Confederation (CBF) as a result of accessed the judiciary before exhausted all walks of Sports Justice. As theoretical framework, we used books, codes, laws, newspapers, journals and papers available on the Internet. The texts analysis showed that the Sports Justice in Brazil is well structured and recognized by the highest law of the country. The fact that a club be punished for entering the judiciary before exhausted all walks of Sports Justice, finds refuge in the Brazilian Code of Sports Justice. Is not considered an act of unconstitutionality against the principle of non-obviationof the Judiciary. |
