El presente trabajo tiene por hipótesis demostrar la falsa dicotomía planteada por el constitucionalismo popular como escuela de oposición al constitucionalismo clásico y, a su vez, explicar la doble función del constitucionalismo como un sano instrumento limitador del poder y un ancla estabilizadora de la democracia para prevenir la dictadura de las mayorías y el llamado despotismo o autocracia electiva. Para ello, se exponen los antecedentes y postulados básicos del constitucionalismo popular, los antecedentes y objetivos del constitucionalismo clásico y se formula un contraste doctrinario entre populismo y constitucionalismo.Since about a decade ago it is making its way into the constitutional theory a self-styled popular constitutionalism current doctrine, nurtured by a growing body of legal literature. It questions and recommends major changes in the categories of thought of classic constitutionalism. This paper aims prove the false dichotomy posed by the popular constitutionalism as a school of opposition to the classic constitutionalism and, in turn, explain the dual role of constitutionalism as a healthy limiter instrument of power and stabilizing anchor of democracy to prevent the dictatorship of the majority, and the called elective despotism or autocracy. For this, the paper describes the history and basic tenets of popular constitutionalism, the background and objectives of classic constitutionalism and makes a doctrinaire contrast between populism and constitutionalism.Fil: Diegues, Jorge Alberto.
