| Sumario: | The twentieth century is mark by an evident process of humanization of the insolvency regime. The subjective budget is being redesign, demanding bigger relevance to the contest of the natural person. The subjective unity and the exclusiveness of the regimen for those who perform an economic, administrative or commercial activity inside the Latin American Law must be questioned, being crucial the categorization of debtors. Even though, the recognition of a debtor, whom for specific reasons: unemployment, medical expenses caused by a sudden disease, personal issues, unexpected death, food, dwelling; in other means, several causes that happen in the current living, it is immersed in what is being called “over-indebtedness”, including the over-indebtedness of the consumer because of debts originated by consumerism, impose a well-timed change. |
