Sumario:In this article, the author analyzes the effectiveness of the Compliance Programs, as a condition to exempt the legal entity from criminal liability, in view of article 31 bis of the Spanish Penal Code. In this line, it approaches the content of the term from a focus on prevention and management of criminal risk, in light of the elements and quality criteria proposed by comparative legislation and international standards of compliance and good corporate governance.
