Sumario:As experts take on an increasingly vital role in international arbitration, the conflicts of interest they may encounter are generating growing concerns about the transparency, impartiality, and legitimacy in the arbitral system. This article examines the regulatory framework applicable to such conflicts, covering both the rules of the world’s leading arbitral institutions and various non-binding instruments aimed at guiding expert conduct. It also examines how different arbitral tribunals have addressed these situations in practice. Based on this analysis, the article proposes mechanisms to strengthen the integrity and legitimacy of international arbitration through clearer regulation and more effective management of conflicts of interest in expert involvement.
