Summary:The coercive procedure is an executive administrative process through which public entities can demand compliance with financial obligations arising from negotiable instruments. Objective: To analyze the right to appeal as a legal protection mechanism within the coercive procedure, through the guarantee of fundamental rights of those subject to administrative action in Ecuador. Materials and methods: The study employed a non-experimental, documentary, and analytical-descriptive design with a mixed-methods approach and a sample of two specialists from the Ecuadorian State Development Bank, selected through purposive non-probability sampling. Results: The study revealed disadvantages of the Ecuadorian system compared to other countries, including insufficient procedural deadlines and excessive requirements. Disproportionality in precautionary measures and the low effectiveness of successful appeals were also confirmed. Furthermore, although progressive, constitutional jurisprudence has not yet transformed administrative practices. Conclusions: The research demonstrated a systematic pattern of disproportionality in the application of precautionary measures within the coercive procedure.
