description El general don José Ballivián, después de haber fracasado en la insurección que efectuara contra el gobierno del general don José Miquel de Velasco el 6 de julio de 1839, se dirigió al Perú, radicandose en Tacna. En aquella ciudad encontró una favorable acojida, á pesar de las prevenciónes, que contra él abrigaba el presidente peruano general don Agustin Gamarra, y desde allí contino conspirando contra Velasco. Fruto de este trabajo subversivo fué la sublevación del batallón Legión acaecida en la fortaleza de Oruro, que debelada oportunamente no tuvo mas resultados, que el fusilamiento de muchos soldados, que llegaban a ser quintados y la fuga a Tacna del sargento Mariano Melgarejo, tuno de los cabecillas de ese motin de cuartel.
