Sumario:This article pretends to justify why a constitutional reform is needed in the subject of children's and adolescent´s rights, a constitutional reform that fits to international instruments, and to the specific theory of this branch of law. Through a brief description of the antecedents of juridical treatment towards infancy and adolescence in the Mexican Constitution, and in international law, it is argumented in favor of the creation of a new lawful frame for children and adolescents. Finally, in order to guarantee the full validity of the Constitutional State for human beings during their first years of life, it is given the basic elements that this constitutional reform should contain.
