| Sumario: | In the Zacatecas criminal law, the rule that considers duel as circumstance for the committing of the crimes of injury and homicide remains in force. We undertook this effort to get to know the social and legal origins of the provision, to try to determine if their existence preserves the social importance of yesteryear and if, as a consequence, it is useful for common coexistence. A sketch outline of its history allowed us to locate the moment in which the struggle is linked to the concept of honor, the how and who of its diffusion in Europe and its adoption in Mexico. We have witnessed that it prevails defying in defiance of earthly and divine punishments. We find national and local legislative efforts to inhibit its existence. We obtained data that made it possible to specify the social and legal change that removed from the honor its past importance and reach the conclusion: the duel no longer represents a social issue with criminal relevance. |
