Sumario:The purpose of this research work is to demonstrate that the denial of access to health services by same-sex marriages is motivated by unequal treatment of these couples on the basis of their sexual preference, which leads to discrimination against their partners, and the violation of their right to dignity, equality, health, certainty legal, among other fundamental rights, generating a state of defenselessness, against individuals and against the State itself. The unit of analysis is the right to health, the variables are: I) The (II) the violation of the fundamental right of access to that right; and access to health services that everyone has. Indicators of the variables: The laws of Social Security and the Institute of Security and Services of the State Workers.
