Sumario:This research addresses the issue of surrogate motherhood in Mexico, with the intention of presenting the evolution and current status of this reproductive modality within the country after the resolution made on June 3, 2021 by the Supreme Court of Justice of the Nation to the Action of Unconstitutionality AI16/2016. Derived from this action, criteria are established for the first time that focus on its attention and legislative development at the national level. This is why the analysis of said resolution will be entered to know its content, scope, and legal impact in relation to the interveners. Especially, this study focuses on the subject of surrogate pregnant women, as they are the main protagonists. Moreover, without their intervention this reproductive modality would simply not exist.
