Sumario:As a result of the transition presented in the Mexican penal system, as a product of the constitutional reform of June 18, 2008, it is convenient to understand the philosophical foundations on which the mixed inquisitorial system that is left and the accusatory system that is adopted is based. That is why it is important to contrast the secrecy that prevails in the first with the transparency that promises the second and, in the same way, it is pertinent to emphasize the presumption of guilt that characterizes the inquisitive system with the right to the presumption of innocence, which has as basic foundation the accusatory system.
