Sumario:This article justifies the joint custody, even with the opposition of one of the parents, as a supplementary legal regime preferred, but primarily as specific within a system of indistinct custody. Shared custody is based on the fundamental rights of children (principles of superior interest and parental co-responsibility), but especially in empirical studies.
