The research collects a qualitative sample of emblematic sentences where the influence of the Convention No 169 is analysed in the judge’s decisionmaking process for indigenous rights. We chose a qualitative sample that does not aim to end the debate on the topic, to the contrary, it opens a discussion in the context of the influence of the legally binding international law in the New Latin American Constitutionalism and other member States of the ILO Convention No 169.El trabajo que se presenta a continuación evalúa la influencia del Convenio 169 de la Organización Internacional del Trabajo (OIT) sobre Pueblos Indígenas y Tribales en la jurisprudencia reciente en materia indígena de los altos tribunales de los países que constituyen el nuevo constitucionalismo latinoamericano: Ecuador, Venezuela y Bolivia. La investigación recoge una muestra sentencias emblemáticas en las que se analiza la influencia del Convenio 169 en la toma de su decisión por parte de los magistrados en pro de los derechos indígenas.
