Sumario:Some experiences of implementation of the new criminal justice systems are analyzed, both at the normative level and in management aspects, regarding the paradigms of presumption of innocence and criminal guarantees, verifying the data of their compliance, their impact on the perception citizen security; to determine or take a position around the apparent dilemma "combat the crime presumption of innocence" counterface or not? To do this, we will have to scrutinize the treatment of preventive detention in the traditional Mexican criminal system, and specifically the particularities of Nayarit, for example, figures of prison overcrowding, percentage of prisoners without convictions, socialization of preventive detention as a precautionary measure or as advance of sentence, perception of insecurity, due process, among others; in order to arrive at a proposal for its adequate implementation under the paradigms of the great 2008 criminal reform and the very important Human Rights reform of June 2011.
