Sumario:This article explores the need to reconsider the name of the public or popular action of unconstitutionality. This review is based on the search for a renewed approach that encompasses not only the underlying legitimacy, but also the parameters that govern the evaluation of constitutional regularity. Emphasis is placed on the importance of achieving conceptual clarity and precision in procedural objectives. The analysis is framed within the scope of constitutional procedural law. In addition, the current application of this concept in Latin America is examined in depth. It deals with standing to sue and the relevance of simple interest. Finally, its incorporation into the Mexican legal system at both federal and state level is proposed.
