On the contrary, both in Colombia and in Mexico there is a profound non-observance of the minimum human rights criteria when determining the prison assignment of trans women.El artículo compara cómo se ha protegido jurídicamente la identidad de género de las mujeres trans privadas de la libertad en Colombia y México. El argumento que guía el desarrollo es que, a pesar de existir múltiples instrumentos internacionales y nacionales que protegen los derechos humanos de las personas trans privadas de la libertad, éstos no encuentran vigencia mínima en la realidad de ambos países.
