Sumario:[EN] Cultural rights are currently the most relevant legal devices to achieve the political project of access to culture. From the beginning, the patrimonial sense of cultural policies was developing different ways of ordering culture. Thus, instruction and cultural consumption have been the main institutional strategies to promote access to culture for citizens. But today there are other different ways of accessing culture, contained in the contemporary account of cultural rights. The article shows the tension between the passive and active rights for access to culture, and presents a simple intuitive and practical proposal to evaluate it. It is a visual device that in a simple and graphic way helps to locate the different gradients of access to culture. Expanding the classical conception of cultural rights in relation to the institutional idea of access to culture, and contemporary problems for its consolidation.
