| Sumario: | European cohesion policy raises many and relevant problems and its research can focus on various topics. This article analyzes the link between the Rule of Law and the financial conditionality, focusing on the object of the Regulation (EU, Euratom) 2020/2092, of the European Parliament and of the Council of 16 December 2020 on a general regime of conditionality for the protection of the Union budget, applicable from January 1, 2021. Financial conditionality involves an attractive mechanism to act against breaches of the Rule of Law when other tools have not been effective. But a correct design is essential to provide this mechanism with legitimacy and to avoid the risk that Member States uses it to reinforce nationalist feelings and to provoke European disaffection among the citizens. Critics of the Regulation on conditionality have said that it increases the Union’s powers in a way contrary to the principle of attribution. This work will try to refute this objection. |
