Sumario:More than twelve years after the adoption of the Noise Law 37/2003 of November 17, and once deployed all its effects, in this paper we analyze the current state of the legal system concerning noise from the perspective of the administrative law. The paper initially focuses on the study of regulatory sources and instruments of the basic legislation to combat noise pollution. Next, the effectiveness of these measures is studied by analyzing the assumptions of liability of the administration, by action or omission, on noise and, also, its attempts to modify such liability through legislative reforms. The paper concludes by stressing the pending problems and future challenges in this sector of environmental law
