The explanatory memorandum of the draft law assimilates these rules with the pre-pack administration. As a preliminary step, it is taken into consideration the comparative experience of those jurisdictions where the practice of pre-pack sales has enjoyed greater success. Attention is also paid to the current situation of the Spanish Law regarding early sales of business units, of which pre-pack sales are part, thus lacking, for the moment, of regulation in Spain. The article also deals with the Spanish judicial practice, with particular reference to the pre-pack protocols of Juzgados Mercantiles of Barcelona and Baleares. After having approached to the draft reform, it is concluded that the reform does not foresees, strictly speaking, a route specifically designed for prepack sales of business units in Spain.El presente trabajo tiene por objeto realizar una aproximación a las normas relativas a la solicitud de concurso con presentación de oferta de adquisición de una o varias unidades productivas y al nombramiento de experto para recabar ofertas en el proyecto de ley de reforma del TRLC, a las que exposición de motivos de la normativa proyectada asimila con el pre-pack administration. Como paso previo, se toma en consideración la experiencia comparada de aquellas jurisdicciones donde la práctica de las ventas prepack ha gozado de mayor predicamento, así como la posición del Derecho español vigente en torno a las ventas anticipadas de unidades productivas, de las que ventas prepack, carentes por el momento de regulación en nuestro país, constituyen una modalidad. Se atiende también a la práctica judicial española, con particular referencia a los protocolos prepack de los Juzgados Mercantiles de Barcelona y de Baleares.
