| Resumo: | Spanish legislation concerning recognition and enforcement of foreign judgments needs urgent reform. This article discusses the issues that should be covered by the reform and the guidelines to establish the content of the new legislation. In this connection, the structure of the system, the decisions covered, the grounds for non-recognition and the procedural questions raised by recognition and declaration of enforceability are thoroughly examined. ---- La legislación española en materia de reconocimiento y ejecución de decisiones extranjeras se halla especialmente necesitada de revisión. Este artículo aborda las cuestiones que deben ser objeto de regulación y las orientaciones que deben prevalecer en la reforma. Para ello, detalla cuál debe ser la estructura del sistema de reconocimiento y ejecución de decisiones, las decisiones susceptibles de reconocimiento, los requisitos del reconocimiento y ejecución, los aspectos de procedimientos y la sede legal de la reforma. |
