It analyses the concepts of carrier and intermediary in road passenger transport, mainly in national regulations, but also at the infra-State level, and raises the possibility that intermediation in the transport of passengers by road has been liberalized. Finally, it contains an evaluation of Uber’s services and it argues that Uber should be classified as a contractual carrier.El trabajo analiza si Uber es un transportista contractual o un intermediario en el transporte de pasajeros por carretera, a la luz de la normativa española. Se estudian las principales decisiones que los tribunales nacionales han dictado con respecto a su actividad, así como la opinión del Abogado General en el Caso C-434/15. A continuación, se analizan los conceptos de transportista e intermediario en el transporte de pasajeros por carretera, principalmente en la legislación estatal, pero también en la autonómica, y se aborda el tema de la posible liberalización de la intermediación en el transporte de pasajeros por carretera.
