Resumo:In the frame of german Federal Constitutional Court’s judgement about Treaty of Lisbon and the spanish Constitutional Court’s doctrine on the relations between the european construction process and national Constitution, this article exposes some conceptual thoughts concerning: (1) EU Member States constitutional identity and (2) its jurisdictional protection; (3) EU implied powers; (4) EU Law primacy and Member States Constitutions; (5) when Member States sovereignty should become EU sovereignty.
