| Resumo: | The projects to «improve» human nature proposed by some defenders of transhumanism under the label «post-humanity» may pose a serious challenge to the principle of equality, one of the foundations of the contemporary liberal juridical-political order. At the philosophical level, the transhumanist challenge is a dispute internal to liberalism itself, centered on the meaning of the concept of individual self-determination, located at the heart of modern juridical-political thought. At legal level, we propose presenting the transhumanist challenge as a thought experiment in order to see its possible consequences in private law. The idea of post-humanity could provoke a crisis of the doctrines of the freedom of contract and the ordinary standard of care. These tensions in the legal dimension highlight the profoundly disruptive effect of transhumanism on the reigning political order. |
