Protection of their rights remains a pending task of legislators and courts. Although the trend in Europe is acceptance, we find a very diverse compared picture. At present there are already twelve European countries that have legalized so-called «gay marriage», although others have chosen civil union laws that omit the term «marriage», and even some of them allow exclusively their registration as cou-ples —or not even—. One of the most controversial issues remains the adoption of children, although the current trend is recognition. The European Court of Human Rights has not resolved the issue, because although they has stated that the Rome Convention does not provide with a right to same-sex marriage, they consent the decision to recognize at the discretion of the States.La igualdad, el derecho a no ser discriminado y el libre desarrollo de la personalidad sin restricciones ligadas a la orientación sexual exigen el reconocimiento jurídico de las parejas del mismo sexo. La protección de sus derechos continúa siendo una tarea pendiente de legisladores y tribunales. Aunque la tendencia en Europa es su aceptación, encontramos un panorama comparado muy diverso. En la actualidad son ya doce los países europeos que han legalizado el mal llamado «matrimonio homosexual», si bien en otros se ha optado por leyes de unión civil que omiten el término matrimonio, y aún algunos solo permiten su inscripción registral como parejas de hecho —o ni siquiera esto—. Una de las cuestiones más controvertidas sigue siendo la adopción de menores, si bien la tendencia actual es su reconocimiento.
