| Sumario: | The legislator, conscious of the need for creating a pre-insolvency proceedings institution which could answer the problems posed by the insolvency of individual businessmen and small companies, which in many occasions cannot accede to those refinancing agreements, has regulated extra-insolvency proceedings, optional for the debtor, aimed at the restructuration of his/her liabilities through a negotiated agreement with his/her creditors, and which is processed outside of the Mercantile Court with the intention of alleviating the work load of those courts and reducing the temporal costs associated with all judicial procedures, particularly high in insolvency proceedings as a result of their collective character and their inner complexities. This work analyzes the main novelties introduced in the extra-judicial payment agreement by the RDL 1/2020 of May 5, by which the consolidated text of Law of Insolvency Proceedings is approved. |
