| Summary: | The objective of this exposition is to analyze the multilevel protection of the core conte nt of the freedom to join a trade union, in European area and at the same time, to present a critical reflection about the possible adhesion of the European Union to the European Convention of Human Rights.This reflection has been motivated for the lack of dialogue between the Court of Strasbourg and the Court of Luxembourg, which has caused divergence between their latter decisions about the essential content of freedom to join a trade union. The expository scheme of the present document starts enumerati ng the three most important international law instruments in the European area, as they are: the European Convention of Human Rights, European Social Charter and the Charter of Fundamental Rights of the European Union. Afterward, they would be analyzed the pronouncements that the two courts have made, which directly affect to the rights to bargain collectively and to strike. To conclude, a reflection will be made on how these contradictions may affect to the possible adhesion of the EU to the ECHR. |
