Sumario:This thesis addresses, firstly, the historical and doctrinal framework in which the figure arises, to then analyze the historical origins of judicial control of the custodial sentence, examine the precedents offered by Comparative Law, set the scopes fundamentals of its performance, after which the various hypotheses are raised in relation to its legal nature. Entering the specific area of ​​competence of the Supervisory Judge, its functions of execution of the sentence are collected and analyzed in its various projections, especially, issues of classification, probation and security measures; its functions in prison treatment, with special significance in the matter of permits; control of the Penitentiary Administration, both in disciplinary matters, and in relation to the control and safeguarding of the rights of inmates. To finish the exposition of its powers, its relevance as a European Judge would be highlighted, within the framework of the Mutual Recognition Law, as issuing authority in the transmission of custodial sentences and certain measures of probation. Finally, the conclusions of the study would be presented and various legislative policy proposals would be formulated.
