Sumario:[EN] The affiliation, insofar as it determines the biological origin of a person, has effects in the personal and patrimonial sphere. Procedures for claiming the paternity of the descendant are regulated in our Spanish legal system. In this study we intend to analyze these procedures and obtain DNA as a means of proof to determine parentage. Of interest, it refers to Law 8/2021, of June 2, which reforms civil and procedural legislation to support people with disabilities in the exercise of their legal capacity, which has affected various provisions of the Code. civil, as well as Law 4/2023, of February 28, for the real and effective equality of trans people and for the guarantee of the rights of LGTBI people. It is necessary to take into account the best interest of the minor, if applicable, and also the different cases of challenge, as well as the different issues that come into play in relation to DNA, as genetic data, especially protected by the applicable regulations.
