Sumario:The present study has two main objectives. First of all, to provide recent reliable data on the practical application of suspended prison sentences. To this end, the paper presents the results of empirical research carried out in the criminal courts of Barcelona and Girona on cases from the years 2015 and 2016. This research enables it to be concluded that, in line with previous studies, the implementation of the suspended sentence is a success story, since it is applied in a generalized manner by our courts. Having verified this success story, the second objective of the paper is to present and discuss the reasons that explain the success of the suspended prison sentence as a penological institution. In this sense, it is argued that the decisive factor is its role as a key instrument for the very survival of the penitentiary and criminal justice system
