Sumario:The vulnerability caused by gender violence in women is aggravated if they suffer from some type of functional diversity. A double discrimination: for being a woman and disabled, triple if it is intellectual, multiplying according to the degree or concurrence of different disabilities. It is necessary to examine the factors that make these women more vulnerable from the perspective of intersectionality of disability and gender, when both act simultaneously. In this context, our criminal legislation does not contemplate these traits of greater vulnerability in conditions of equality with women without disabilities, since it treats them together with minorities or as vulnerable persons worthy of protection, causing a different "category of women". relegating her to her role as a specially protected victim without considering her special and specific circumstances that should lead to greater criminal protection or overprotecting her by limiting, even unintentionally, her rights in relation to other women.
