It was concluded that in the end the legislator has tried to be a mediator between the employer and the workers in order to seek to produce the most favorable legal consequences for both in this process of business transfer. As a proposal, it is suggested that the courts and other supervisory bodies continue to monitor these issues in order to maintain the meaning and scope of the legal norm in these cases of transfer of companiesEl objetivo de esta investigación se basa en analizar la sucesión empresarial desde la perspectiva laboral en España. En éste trabajo se realiza un análisis de las vertientes relacionadas con ésta problemática de estudio. La investigación es de tipo descriptiva, comprensiva e interpretativa. Pudo concluirse que en definitiva el legislador ha intentado ser mediador entre el patrono y los trabajadores a los fines de buscar que se produzcan las consecuencias jurídicas más favorables para ambos en este proceso de transmisión empresarial.
