Curso 2015-2017[EN] En este trabajo se pretende analizar en que consiste la partición hereditaria, así como sus diferentes modalidades y los entresijos que pueden surgir en cada una de ellas. Centraremos especial atención a la partición extrajudicial, y más concretamente a la figura del contador-partidor, eso sí, sin dejar de lado la partición judicial y la partición arbitral. Estudiaremos los cambios surgidos respecto al contador–partidor dativo, con las recientes reformas que la LJV ha introducido y analizaremos las operaciones particionales, prestando especial atención a la colación, dada su importancia en los procesos en que existen herederos forzosos. Para finalizar veremos la eficacia que tiene la partición hereditaria así como su impugnación. Además podremos ver algunos problemas que se pueden plantear en la partición hereditaria y analizaremos diferentes puntos de vista de la doctrina analizando sus posiciones y argumentos. Para finalizar debo mencionar el especial papel de la jurisprudencia empleada, especialmente del Tribunal Supremo y de las resoluciones de la DGRN, con el fin de poder ver distintas soluciones a los problemas planteados y esclarecer lo máximo posible las dudas que nos puedan surgir en la materia de la partición hereditaria.[EN] This essay pretends to analyze what hereditary partition consists in, also its different modalities and the intricacies that could appear in each one of them. We will pay special attention to the extrajudicial partition, and more specifically to the partition action attorney´s role, not forgetting to mention judicial and arbitrary partition. We will study the changes that have appeared referring to the dative partition action attorney, with all the recent reforms that the LJV has introduced and we will analyze partition actions, having a special look at the hereditary collation, considering its importance in heir apparent processes. To end with it we will see the efficiency that hereditary partition has as well as its impugnation. Also we will be able to see some of the problems that can be proposed in hereditary partition and we will analyze different points of view from the doctrine searching over their poses and arguments. As a final note I should mention that jurisprudence has had a special role when it has been used, specially from the “Tribunal Supremo” (higher court in Spain) and also the resolutions of the DGRN, with the aim of being able to see different solutions to the problems that have been proposed and to clarify as easy as possible al the doubts that can come up in within the subject of hereditary partition.García-Bernalt San Román, Javier201720172016info:eu-repo/semantics/masterThesisapplication/pdfhttp://hdl.handle.net/10366/132680reponame:GREDOS.
