Descripción
Sumario:This article examines the role of the Defender of the Bond in the processus matrimonialis brevior, highlighting the importance of this prominent role in representing the public good throughout the various stages of this form of the process (especially given the active litis consortio of the spouses). Guaranteeing the existence of a process in contradictorio, the Defender is not just a formal, precautionary requirement; rather, it represents a real, substantial role that is required to – in the words of Pope St. John Paul II – “investigate, propose, and clarify all that could reasonably be cited against nullity.” This article, then, analyzes the content and spirit of this ministry’s contribution to the entire dynamic of the process (introduction, instruction, discussion, and the delicate task associated with a possible challenge against the Bishop’s sentence). Given that the functionality of the processus brevior requires competent and motivated Defenders of the Bond, this article notes the demand for sincere determination, adequate formation and unconditional commitment to defense of the bond.
