Resumo:The human right to water has generated broad debates and ambivalence, both in its theoretical conceptualization and its recognition as well as in its practical realization. Last February 2018 the European Commission presented the proposal for revision and modification of Directive 98/83 / EC, which in response to the European Citizen Initiative Right2Water includes a forecast regarding the right to water. In this article we critically analyse the proposal, focusing on the content and scope of the new text of the Directive in relation to the right to water, whose main criticism is its abandonment of the universalist logic of the human right to adopt a logic of exclusion and segmentation, limiting public policies to guarantee the right to collectives called “vulnerable”
