| Sumario: | This paper analyses the cases in which persons who have been convicted of crimes of jihadist terrorism cooperate with judicial authorities and such behavior was considered as a mitigating circumstance by both the National Court and the Supreme Court. Such research is conducted in order to achieve two objectives: on the one hand, to identify the reasons behind this behavior, and, on the other, to assess the modifi cation of the pre-trial detention, frequently ordered in these procedures, in case it could encourage cooperation with justice by the individuals convicted of these crimes in the future. |
