| Sumario: | The purpose of this dissertation is to expose the legal problems raised by tourist housing in the collaborative economy from the Unfair Competition Law point of view. First of all, the origin and current context of the issue is pointed out, with particular emphasis on the regulatory disparity in this new legal figure caused by the different local norms on the matter. Next, we study the possibility that the practices carried out by these business could have an unfair character based on the violation of the norms of art. 15 and the transgression of the good faith of art. 4 of the Law 3/1991, of January 10, of Unfair Competition. Finally, we offer an epilogue that could be useful in order to elaborate new rules on collaborative tourism. |
