Resumo:The reforms intervened in the Statutes of Autonomy of different Spanish regions after 2006 have made Law-Decree available for regional governments. This kind of legislation made, only in special cases (emergency situations), by the government has a lot of problems, as we already know because of the experience of its use by the Government of Spain. Autonomic Law-Decree raises an additional issue that have not been analysed until now: whether the instrument itself can be considered in accordance with the frame established by the Spanish Constitution. This paper will argue that a strict interpretation of the Constitutional framework leads to the conclusion that Law-Decree in Spanish Public Law is only available for the State Government.
