Descripción
Sumario:This article deals with the question if the right to self-determination, enshrined in the International Covenant for Civil and Political Rights (ICCPR), might be invoked to defend the secession of one of the Spanish regions. Beginning with reminder of the process that lead to the recognition of a right to self-determination in Public International Law, this contribution analyses what is the legal status of ICCPR in the Spanish legal order and then recalls the failure of the attempts to introduce in the Spanish domestic legal order a secessionist claim based on the ICCPR and that the doctrine of the United Nations Human Rights Committee did not support such interpretation.
