Sumario:The research focuses on the development of a critical legal analysis on the validity of the alcohol test and narco test in traffic violations, to the driver who, under the influence of controlled controlled substances, allows elements of conviction to be obtained through the test. alcohol test or narco test. Similarly, it seeks to address the validity of that consent from a critical legal perspective, given the nature, content and scope of the sanction established for this type of infraction in Ecuadorian criminal law, and the violation of rights is analyzed. and constitutionally protected guarantees, such is the case of the prohibition to selfincriminate. The question of whether the alcohol test or drug test in cases of accidents or traffic accidents violates this prohibition of self-incrimination is raised as a research problem. After the doctrinal, normative documentary analysis and statistical figures, which illustrate the situation of the occurrence of traffic accidents that fall within the criminal types contained in the Comprehensive Criminal Organic Code, it is conclusively inferred that it enshrines principles that they seek to address the rights of all individuals in society, above private interests.
