| Resumo: | The present investigation is made up of the analysis and study that starts from the investigation of human mobility as the basis of a variety of rights that are based on the principles of universal citizenship and free mobility. So also in recent times Ecuador has received a large number of foreigners from other nations, who have seen the country as a place that can provide them with a better quality of life. Many migrants may be victims of cruel, inhuman and degrading treatment, and some have even been deprived of liberty to be subsequently irregularly deported to their country of origin; unconstitutional, arbitrary and illegal procedure in which even authorities were immersed who had to safeguard rights, directly violating both national and international regulations. For this, the research method of quantitative and qualitative type was used because it is a study of a social and legal nature, and the descriptive method was also used since the data obtained through the research can achieve results that characterize the problem, in relation to the dogmatic legal method, it was possible to investigate and objectively analyze the consequences generated by current regulations. Furthermore, the nature of this work is documentary based on books and texts that cover the problems of study. All this in order to investigate whether the action of Habeas Corpus is an effective legal protection mechanism for human rights. |
