| Summary: | The objective of this research work is to analyze the association or consortium regarding its lack of regulation in the Ecuadorian legal system, noting important aspects such as the regulations that seek to regulate it without achieving its objective. In addition, the aim is to compare the legal reality of Ecuador with that of other Latin American countries regarding this controversial figure. An in-depth study was carried out applying a qualitative comparative methodology on the regulations that treat the consortiums from the constitutional, civil, societal and public procurement point of view, without neglecting the resolutions of the National Public Procurement Service that indicate certain rules for the creation of associations or consortiums that seek to contract with the public administration and its institutions. This study allowed to conclude the lack of regulation of this institution object of this investigative work and gave way to recommendations for its inclusion in the different legal bodies. |
