| Sumario: | ABSTRACT: ABSTRACT This investigation aims to determine the scope of the non-contractual responsibility of the Ecuadorian State in the massacres that took place in the country in 2021, in which around 300 people deprived of liberty died, in the Ecuadorian prison system, where thousands of inmates are linked to drug trafficking gangs and the rivalries of the different groups which have frequently generated riots, some of the dead were beheaded and charred and dozens were wounded. The obligation of the Ecuadorian State in social rehabilitation centers is to guarantee the safety of persons deprived of their liberty, implementing protocols to prevent riots, avoid overcrowding, have adequate personnel assigned to security and internal surveillance; impose effective controls to prevent the entry of alcoholic beverages, weapons, narcotic and psychotropic substances, access to telephones so that they have a communication system and prevent the actions of criminal organizations in prisons, with everything described it has been possible to show that within of the social rehabilitation centers in the year 2021 the Ecuadorian State has not fully complied with its state obligations. Based on what has been indicated, it is necessary to determine if the successors in title can sue the State and obtain pecuniary compensation for this matter at the national level or in the Inter-American Court of Human Rights.
