Sumario:Ecuador incorporated the criminal offense of femicide with the approval of the Comprehensive Organic Penal Code, when it came into force, problems arose in judicial application. In this work, it will be determined whether the justice operators involved in the criminal offense of femicide present practical difficulties when they lack a gender perspective or are unaware of the subject and other accessory branches such as psychology, sociology, anthropology, gender, among others. The objective of this research is to dogmatically analyze the categories of the criminal type of femicide with a gender perspective, to establish the process of social construction and determine the elements of objective typicity according to the Ecuadorian criminal normative framework. This degree work was based on a mixed or multimodal research approach, that is, qualitative and quantitative research was combined. From an empiricalqualitative methodology the type of research was descriptive, documentary; This type of research that was applied is within the interpretive paradigm. To carry out this investigation a practical case was analyzed, the specific and media case is the femicide of Diana Carolina raised in the city of Ibarra in the presence of police members, who dies stabbed by her sentimental partner and the attack loses her life. woman and the child she carried in her womb since she was in a state of pregnancy, generating a social impact from a gender perspective.
