spelling La acción de protección y su incidencia en los derechos humanosAlmache Vaca, Néstor EmilioACCIÓNPROTECCIÓNGARANTÍADERECHOSDERECHO CONSTITUCIONALIn the present degree work, an analysis of the protection action in Ecuadorian legislation is made, its antecedents, its incidence in the protection of human rights established in the Constitution and in the International Instruments ratified by the State, the denaturalization that is has evidenced during its validity, the shortcomings found for an effective and prompt response from the State before the recurrence of citizenship and the responsibility this against this constitutional guarantee, reforms will also be proposed to various Laws that contain provisions that in some way prevent a response adequate to the demand of society in the face of abuses, especially in the public sector and also in the private sector and that are related to the indicated action, as well as the necessary permanent training for Judges, Lawyers in free professional practice and public servants in general, taking into account that most of the resolutions and decisions of power emanate from the latter, which in not a few cases have violated the fundamental rights of citizens, for whom their administrative and other actions are directed.En el presente trabajo de titulación se hace un análisis de la acción de protección en la legislación ecuatoriana, sus antecedentes, su incidencia en la protección de los derechos humanos establecidos en la Constitución y en los Instrumentos Internacionales ratificados por el Estado, la desnaturalización que se ha evidenciado durante su vigencia, las falencias encontradas para una eficaz y pronta respuestas del Estado ante la recurrencia de la ciudadanía y la responsabilidad este frete a esta garantía constitucional, se propondrá también reformas a varias Leyes que contienen disposiciones que de alguna forma impiden una respuesta adecuada a la demanda de la sociedad frente a los atropellos especialmente del sector público y también del sector privado y que tienen relación con la señalada acción, así como la necesaria capacitación permanente a Jueces, Abogados en libre ejercicio profesional y a los servidores públicos en general, tomando en cuenta que de estos últimos emanan la mayor parte de resoluciones y decisiones del poder, que en no muy pocos casos han vulnerado los derechos fundamentales de los ciudadanos, para quienes están dirigidas sus acciones administrativas y de otra índole.Ecuador : Latacunga: Universidad Técnica de Cotopaxi (UTC)Saca Balladares, Melinton Fernando2023-06-07T17:03:16Z2023-06-07T17:03:16Z2023info:eu-repo/semantics/publishedVersioninfo:eu-repo/semantics/masterThesis77 páginasAlmache Vaca Néstor Emilio (2023); La acción de protección y su incidencia en los derechos humanos.
