Summary:This research analyzes the exceptions to the validity of the illegal evidence in the Ecuadorian criminal procedure; Also the defenses arising from the common law such as unavoidable discovery, police good faith, independent source, which can be applied by judges, prior to their exclusion by the balancing test. A theoretical, historical, doctrinal, field and comparative study the problems described, the context is part of the respect for fundamental rights protected by the State and its limits. So our proposal is the use of this exceptions in Ecuador.
