| Sumario: | In our Ecuadorian justice system, as well as the international treaties and conventions ratified in Ecuador, pre-trial detention is a precautionary measure of a personal nature, guaranteeing the appearance of the defendant to carry out the investigation at all stages, taking into account the restriction to the freedom of the person. The Organic Comprehensive Criminal Code (COIP), preventive detention within Ecuadorian article 534, establishing the following guidelines that must be met for this to be ordered, such as the elements of conviction that demonstrate the crime for which it is being charged, same as They must be clear and precise, indications justifying that the other precautionary measures are insufficient to guarantee the appearance at trial of the accused and that the crime that is sanctioned is greater than one year. In the same way, the methodology of the present investigation will be in a historical, descriptive, explanatory and experimental way, from here it is born how to reduce the levels of prison overcrowding; because when developing the present investigation, the advantages and disadvantages that occur in the justice system at the time of imparting the fundamental principles will be seen in a more concrete way, as it is seen in most Latin American countries. Precisely, proportionality constitutes the ideal mechanism where it allows the judge to impose a precautionary measure according to the crime. In this study, it addresses the legal importance that it be in an effective and partial way where the state guarantees all people. |
